Miami U. Accused of Not Protecting Student From Rape

HAMILTON, Ohio — A former Miami University student, who was allegedly raped in 2011, has filed a lawsuit against the college, stating that the incident could have been prevented if school officials had expelled her attacker for prior misconduct.

The plaintiff reported her rape to Miami University personnel in October 2011; however, three years prior, another woman reported that the plaintiff’s attacker had violated her. According to the lawsuit, two years before the plaintiff’s attack, local police had investigated the accused assailant for secretly videotaping consensual sex and showing the video to others without the women’s consent, WCPO.com reports.

Although the accused attacker was expelled after the plaintiff reported her rape, the suit charges that Miami University officials should have expelled him for violating the Student Code of Conduct for the student’s past behavior.

The suit asks for punitive damages.
