An expelled Occidental College male student has filed a Title IX complaint against Occidental College in Los Angeles, according to a Business Insider report.

The student, known as John Doe in the complaint, was a freshman last year when he was suspended for a sexual assault against a female student, known as Jane Doe.

In the Title IX complaint, John Doe said he had “consensual, albeit intoxicated, sexual intercourse,” with Jane, using text messages received from her that he claims consent to sex.

John Doe said in the Title IX complaint, he filed a claim against Jane Doe for sexual misconduct for which the school didn’t open up an investigation.  He said since they investigated him, but not her that it shows a “clear sex-based discrimination.”

In John Doe’s complaint, he also includes an email from Occidental’s Title IX coordinator Ruth Jones, which she says he made inconsistent statements with earlier testimony, refused to meet with an outside lawyer and had a problem with the timing of the complaint.
